1. Control labour cost

In a developing country, payroll expenses are one of the costs that employers will pay attention to because most factories are still depending on manpower heavily.

[Latest Update] PATI Program Rekalibrasi Malaysia Requirements

Before getting into the details or updates of PATI Program Rekalibrasi, let’s refresh a bit about the history of Malaysia’s program for illegal workers.

PATI Recalibration Programme in Malay is known as PATI Program Rekalibrasi Tenaga Kerja (RTK).

This is a programme to legalize illegal workers or undocumented workers in Malaysia. Employers are able to complete the application by themselves or appoint a recruitment agency with license C to apply on behalf. Nonetheless, it’s hard to meet the PATI Program Rekalibrasi requirements.

Unfortunately, Malaysia’s government decided to extend this program from 30th June 2021 to 1st Dec 2021.

Also, they finally allow the service sector to participate in PATI Program Rekalibrasi.

Do take note that NOT all businesses in the service sector are allowed to apply PATI Program Rekalibrasi.

Fomema also known as Foreign Workers Medical Examination Monitoring Agency.

According to FOMEMA official website, FOMEMA is a (outsourced) private enterprise company designated by the Malaysian government to provide medical examination services for foreigners to work in Malaysia.

In addition, it means every foreigner who wants to work locally, a comprehensive health screening must be done by FOMEMA.

So, while applying or renewing permit FOMEMA medical check up is one of the procedures that must be completed.

How To Buy FOMEMA?

1. Purchase at Fomema’s office- walk in.

2. Browse https://portal.fomema.my/users/sign_in to purchase.

Before you start to pay online, please make sure your worker insurance’s details are with you.

Step 1: After log into your account, at the option bar choose worker list > choose your worker name > add to cart

Step 2: If there is a little green tick beside your worker’s name, means it’s successfully added into the cart, so kindly pay attention to the green tick. Once done, click view cart.

Step 3: Click worker’s name > purchase medical form

Step 4: Choose your payment method, there will be a convenience fee charges.

Step 5: Continue to pay your worker’s FOMEMA.

Step 6: After payment > tick your worker’s name > submit your chosen clinic

Step 7:  Tick your worker’s name > key in the clinic name > save

Step 8: Print the form out and bring it along to the clinic that you book.

Types Of Licenses in Malaysia

To operate a business in Malaysia, applying a company license is a must. Business licenses include licenses, registrations, permits and approvals. The compliance requirements vary by industry, business activity and location.

Business licenses are required by the legislation and administered by various government agencies, statutory bodies and local authorities.

In Malaysia, there are three types of business licenses:

  1. General licenses
  2. Sector Industry Specific licenses
  3. Activity Specific licenses
General License

General Licenses include the necessary business licenses and will apply when the investor decides to start a business in Malaysia.

List of General Licenses, applicable to any business including:

  1. Company Registration
  2. Company and Employees Income Tax Registration
  3. Employees Provident Fund (EPF)
  4. Social Security Organisation (PERKESO)
  5. Human Resources Development Fund (HRDF)
  6. Business Premise Licenses and Signboard Licenses

Activity-Specific Licenses

Activity-Specific licenses are licenses that regulate particular activities and could be applicable to one or more Industries or Sectors.

This category of license requires investor to comply with sets of specific guidelines designed to protect the interest of the citizen, employment, safety of workers, environment and general public.

Examples of Activity-Specific Licenses are:

  1. Certificate of Fitness for Certified Machinery
  2. Approval for Expatriate Posts
  3. Approval to install/resite/alter Air Pollution Control Equipment (bag filter and chimney)
  4. Building Plan Approval
  5. Sales Tax License

Recruiter License

As a recruiter company, we need a business license either. In this industry, there are three types of licenses, which is License A, License B, License C.

By getting a license, business owners need to pay for some fees which is paid-up capital, guarantee fee and more. Different category of license have different charges.

The purpose of holding a guarantee fee is to make sure that all business owner won’t break the industry rules.

Once they break, the government have the rights to confiscate the guarantee fee from the business owner.

As we know that the government have released a new program called The PATI Rekalibrasi Program.

Date: Nov 16th 2020 to 30th Jun 2021

Purpose:

  1. A special program to legalize part of illegal workers in Malaysia to become legal workers – Program Rekalibrasi Tenaga Kerja
  2. Allow illegal workers to return to their country by self surrender – Program Rekalibrasi Pulang

Involved Department: Immigration Department of Malaysia (JIM) & Department of Labor Peninsular Malaysia (JTKSM)

For employer who eligible to apply PATI Program Rekalibrasi

As the latest rehiring program ( PATI Rekalibrasi Program) announced in a sudden and without any information, it caused a minor confusion to all local employers.

Fortunately, One Stop Manpower finally gathered all information. Below are 4 criteria to employer who plan to participate in PATI Rekalibrasi Program.

  • Company not blacklisted or under suspension list
  • Only available for 4 sectors: manufacturing, construction, agriculture & plantations
  • Subject to the quota approved by JTKSM
  • Comply with the conditions for hiring foreign workers

  • Age below 45 years old
  • Not in suspect list & blacklist
  • Valid passport at least 18 months

Please do take note that employee must: –

Deposit: RM500 per foreign worker

Compound: RM1500 per foreign worker

Types of Visa in Malaysia

Malaysia is a perfect country to visit. No matter if it is for travel or business purposes, foreign nationals are able to seek excitement and opportunities in Malaysia. Therefore, foreign nationals will prefer to stay longer in Malaysia. Hence, before applying for a visa do check the functionality and validity of it.

Below are the types of visa in Malaysia:

Multiple-entry visa

This visa is issued to foreign nationals who need to enter Malaysia for business or government-to-government matters. Normally, the valid date for this visa can be 3 to 12 months from the date after approved. The validity of the Multiple Entry Visa is a year. Each entry is for 30 days only and the extension of stay is strictly not allowed. Indian and Chinese citizens who wish to visit Malaysia with the purpose of a social visit (tourism) are also eligible to get this visa to Malaysia.

Below are the important requirements to apply multiple-entry:

  • The applicant must show proof of sufficient funds for staying in Malaysia
  • The applicant must possess a valid and confirmed return ticket
  • Tour groups are not eligible to apply for a Multiple Entry Visa.

Airport transit visa

Airport transit visa is also known as transit visa. This visa is issued to foreign nationals who need to transit in Malaysia to another country and will leave Malaysia’s airport. For those who do not have to leave the airport, this visa is not required to apply.

Single-entry visa

This visa is for the purpose of a social visit in Malaysia. Each entry is for 30 days only and the extension of stay is not allowed.

Work and Holiday Visa

Work & holiday visa is under a special program with Australia. This program provides the opportunities to young people in Malaysia & Australia to work temporarily to cover daily expenses during travelling in the country.

Requirements to apply as below:

  1. Intended primarily to holiday in Malaysia or Australia for a specified period;
  2. Aged between eighteen (18) and thirty (30) years at the time of the application for the visa;
  3. Hold tertiary qualifications, or have successfully completed at least two (2) years of undergraduate studies at a university;
  4. Able to communicate in English proficiently;
  5. Are not accompanied by dependent children;
  6. Have not previously taken part in the ‘Work and Holiday’ programme;
  7. Possess a valid passport and a return travel ticket or have sufficient funds to purchase such a ticket;
  8. Have sufficient funds for their upkeep during the initial period of living in Malaysia or Australia,;
  9. Meet health requirements:
    a. Malaysian applicants – Meet Australia’s health requirements;
    b. Australian applicants – Required to have good health with valid medical certificates issued by qualified doctors in Australia; and
  10. Be of good character.

Those who have entered Malaysia or Australia on a ‘Work and Holiday’ Visa will be required to comply with the respective laws, rules and regulations of Malaysia and Australia and not engage in employment that is contrary to the purpose of the ‘Work and Holiday’ programme.

  1. For both Malaysians and Australians, the principal purpose of the ‘Work and Holiday’ programme is to encourage travelling with work being incidental to the holiday;
  2. Australian participants of this programme are not allowed to work in the following sectors:-
    any firm or company which requires professional qualifications;
    – the entertainment industry such as singing and dancing;
    – the spa;
    – the service counter (front office); and
    voluntary activity.
  3. For both Malaysians and Australians, ‘Work and Holiday’ holders must not be employed by any one employer for more than six (6) months;
  4. For both Malaysians and Australians, ‘Work and Holiday’ Visa holders will not be permitted to engage in any studies or training for more than four (4) months of the visit;
  5. For both Malaysians and Australians, a ‘Work and Holiday’ Visa will automatically entitle the visa holder to work and reside temporarily in Malaysia or Australia;
  6. A Malaysian citizen can apply for the “Work and Holiday ‘programme at the Australian Embassy in Malaysia and an Australian citizen can apply for the same programme at the Malaysian Embassy in Australia;
  7. Applicants for ‘Work and Holiday’ Visas will need to provide a letter from the relevant government ministry which selected them to participate in the programme to ensure that they meet all the eligibility requirements; and
  8. Applicants will be interviewed, when necessary, by representatives of each country to determine their eligibility for the grant of a visa.

eNTRI visa

eNTRI also known as Electronic Travel Registration & Information visa. eNTRI visa is an online registration which facilities the entrance of eligible citizens to Malaysia under the country’s visa waiver program. This program is only open to China and India. Upon arrival in Malaysia, a note will be issued as proof of the registration is required to present. Bear in mind, these visa holders are only allowed to stay in Malaysia for not more than 15 days. No extension is allowed.

Applicants residing inside India or China must have a direct flight from India or China to Malaysia and direct return flight ticket from Malaysia to India or China or transit via Singapore, Thailand or Brunei by air or land is permitted to enter Malaysia and exit Malaysia via the following Entry / Exit points:

  • Kuala Lumpur International Airport, Sepang (KLIA & KLIA 2)
  • Penang International Airport, Pulau Pinang
  • Langkawi International Airport, Kedah
  • Melaka International Airport, Melaka
  • Senai International Airport, Johor
  • Kuching International Airport, Sarawak
  • Miri International Airport, Sarawak
  • Kota Kinabalu International Airport, Sabah
  • Labuan International Airport, Sabah
By Land
  • Sultan Iskandar Building Immigration Checkpoint, Johor
  • Sultan Abu Bakar Checkpoint, Johor
  • Padang Besar Checkpoint, Perlis
  • Bukit Kayu Hitam Checkpoint, Kedah
  • Sungai Tujuh Immigration Checkpoint, Sarawak
  • Tedungan Immigration Checkpoint, Sarawak

This following documents are required to be presented upon arrival in Malaysia entry checkpoints:

  • eNTRI printout.
  • Boarding pass.
  • Sufficient funds (Cash/Debit or Credit Cards with UnionPay logo/Travellers Cheque).
  • Confirmed returned flight tickets.

eVisa

This is a very convenient visa to apply. It is an online application platform that allows foreign nationals to apply for an electronic visa to enter Malaysia. eVISA is valid for 3 months while eVISA holders are entitled to stay up not more than 30 days for each visit in Malaysia depending on the type of the eVISA.

Below countries are eligible to apply eVISA:

  • India
  • Sri Lanka
  • Nepal
  • Myanmar
  • Bangladesh
  • Pakistan
  • Bhutan
  • Serbia
  • Montenegro
  • China

Under the eVISA category, there is eVISA medical. This visa is for foreign nationals who seek health care in Malaysia. Patients can stay up to 90 days but appointments are only available for private hospitals. Public healthcare is not allowed for eVISA holders.
